Welcome to Career Setu (“App”), a platform provided by Nirvikalp Foundation (“we”, “us”, “our”). These Terms & Conditions (“Terms”) govern your access to and use of the App, whether you are an Employer posting jobs or an Employee/Job Seeker applying to them. By creating an account, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

Important Disclaimer: We are Nirvikalp Foundation Trust, and the development company iTech Solutions. We are not responsible for any data, contact details, or mobile numbers provided by users (employers or job seekers). Please verify all details before adding your photo and other contact information, and before engaging with other users.

1) Eligibility & Accounts

You must be legally competent to contract and at least the minimum age required by applicable law to use the App.
You are responsible for the accuracy of your registration information, safeguarding your login credentials, and all activity under your account.
We may suspend or terminate accounts that violate these Terms or applicable law.

2) Roles & Use of the App

Employers: may create company profiles, post job listings, view/apply candidate profiles (as permitted), and communicate with job seekers.

Employees/Job Seekers: may create profiles, upload resumes/photos, search/apply to jobs, and communicate with employers.

You agree to use the App only for lawful recruitment or job-seeking purposes.
You will not misrepresent identity, qualifications, job details, or affiliations.
All communications must be respectful and non-discriminatory.

3) User Content & Responsibility

“User Content” includes job posts, resumes, photos, messages, and any information you submit.
You represent that you own or have the right to share the User Content and that it is accurate, lawful, and non-infringing.
You are solely responsible for your User Content. We may remove or restrict content that we reasonably believe violates these Terms or law.

4) No Verification or Endorsement

We do not guarantee, endorse, verify, or vet employers, job seekers, job listings, qualifications, identities, or communications. You must conduct your own due diligence and exercise caution before sharing personal information, attending interviews, paying fees, or accepting offers.

5) Prohibited Conduct

Posting false, misleading, abusive, obscene, discriminatory, or illegal content.
Sending spam, phishing, or fraudulent messages; soliciting money for jobs or interviews.
Reverse engineering, scraping, or interfering with the App’s security or operations.
Sharing others’ personal data without consent or violating applicable data protection laws.

6) Intellectual Property

The App, its design, trademarks, and software are owned by or licensed to Nirvikalp Foundation. All rights reserved.
By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, display, and transmit it to operate the App.

7) Privacy

Your use of the App is also governed by our Privacy Policy. Please review it to understand how we collect and process information.

8) Fees & Payments (If Applicable)

Some features may be free; others may be paid. Prices, taxes, and billing terms (if any) will be disclosed within the App.
Payments, if processed by third-party gateways, are subject to their terms and security practices.

9) Availability & Changes

We may modify, suspend, or discontinue features or the App at any time, with or without notice.
We may update these Terms occasionally. Material changes will be communicated in the App; continued use means you accept the updated Terms.

10) Disclaimers

The App is provided on an “as is” and “as available” basis without warranties of any kind, express or implied. Without limiting the foregoing, we do not warrant uninterrupted access, accuracy of listings, or error-free operation.

11) Limitation of Liability

To the maximum extent permitted by law, Nirvikalp Foundation and iTech Solutions shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of data, profits, goodwill, or reputation arising from or related to your use of (or inability to use) the App, user interactions, or reliance on user-provided information.

12) Indemnity

You agree to indemnify and hold harmless Nirvikalp Foundation, iTech Solutions, and their officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your use of the App, your User Content, or your violation of these Terms or applicable laws.

13) Third-Party Links & Services

The App may contain links to third-party sites or integrate third-party services. We are not responsible for their content or practices. Your use of such services is at your own risk and subject to their terms.

14) Termination

We may suspend or terminate your access to the App at any time for any breach of these Terms or applicable law. You may stop using the App at any time; some obligations (e.g., indemnity) survive termination.

15) Governing Law & Dispute Resolution

These Terms are governed by the laws of [Insert Jurisdiction], without regard to conflict of law principles. Disputes shall be subject to the exclusive jurisdiction of the courts located in [Insert Venue]. You agree to first attempt to resolve disputes with us informally before seeking court relief.
